Business project service terms

Additional terms for fixed-scope and project-based small-business services including New Business Technology Setup, Business Launch, Business IT Reset, Microsoft 365 & Business Email projects and Business Tech Health Checks.

1. How these project terms fit with your quote

These terms supplement our general Terms and conditions, Service terms, Payments, warranties and consumer rights and Privacy policy. Your accepted written quote or project approval identifies the actual scope, price or price basis and any service-specific assumptions. If there is an inconsistency, mandatory law applies first, then the specific written project terms you accepted, then these terms to the extent they are consistent.

Nothing in these terms excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded or limited.

2. Starting prices and fixed-scope packages

Website prices such as “From $690”, “From $1,290”, “From $1,490” or “From $2,990” are starting or base-scope prices for the inclusions shown. They are not a promise that every business can be completed for that amount.

Before paid work begins, we confirm the agreed scope and price or price basis. Additional users, devices, mailboxes, domains, website pages, content work, large or legacy migrations, difficult account recovery, damaged systems, unexpected technical dependencies, travel outside the included area, third-party tooling or customer-requested changes may require a revised quote or separate approval.

We do not intentionally perform material out-of-scope paid work without explaining the change and obtaining the applicable approval.

3. Third-party licences, subscriptions and platforms

Microsoft 365 licences, domain registrations, hosting, premium plugins, migration tools and other third-party subscriptions are separate from our project fee unless the accepted quote specifically says they are included.

Third-party products and services are supplied under their own provider terms, availability, pricing and technical limits. We can configure and connect them within the agreed scope, but we do not control their uptime, policy changes, service discontinuation, account-verification decisions or future pricing.

Where reasonably practicable, business-critical accounts are created, transferred or documented so the customer business retains appropriate ownership, administrator and recovery access. Some platforms may impose their own ownership, reseller or tenancy structures.

4. Customer responsibilities and authority

You must provide accurate information reasonably needed for the project and must have authority to ask us to access, configure, migrate or change the relevant business accounts, domains, devices, files and systems.

5. Data, email and migration projects

Migration work is based on the source system, account access, mailbox or data volume, provider capabilities and the scope confirmed before the move. Legacy formats, corrupt data, unavailable accounts, provider throttling, storage limits, unsupported features or incomplete source data can affect the result or timing.

Where reasonably possible, important source data should be backed up before a migration or significant configuration change. We will take reasonable care, but a migration cannot guarantee that every historic item, metadata field, rule, permission, calendar detail, application integration or unsupported feature will transfer exactly between different platforms.

We will not deliberately delete or decommission an important source system as part of a migration unless that action is within the agreed scope and the required customer approval or verification has occurred.

6. Websites, content and search visibility

Website projects cover the pages, functions, content assistance, forms and integrations stated in the accepted scope. For standard Solo Website Care and Small Business Website Care builds, the platform is WordPress using an approved, well-supported free WordPress theme selected by Your IT and Tech Mates for the agreed requirements. Premium themes, paid plugins, custom themes, custom plugins, bespoke templates and substantial custom coding are separate unless expressly included in the accepted quote.

Additional pages, copywriting, photography, ecommerce, booking systems, custom integrations, accessibility remediation, legal drafting, substantial revision rounds or work outside the reasonable capabilities of the agreed theme and components are outside the base scope unless listed.

We can apply reasonable technical and on-page SEO practices within the agreed scope, but search engines, advertising platforms and third-party directories control their own results. We do not guarantee a particular Google ranking, traffic level, lead volume, sales result or approval by a third-party platform.

The customer remains responsible for the accuracy, legality and business claims in customer-supplied content and for obtaining appropriate professional advice for regulated claims, industry-specific disclosures or legal documents.

7. Security work and health checks

Security configuration can reduce risk but cannot make a business, device, account or website immune from compromise, fraud, malware, human error or future vulnerabilities. Recommendations reflect the agreed scope and information available at the time.

A Business Tech Health Check is a practical technology review intended to identify obvious ownership, access, device, cloud, backup and security issues. Unless expressly quoted otherwise, it is not a penetration test, forensic investigation, regulated audit, compliance certification, legal opinion or guarantee that no vulnerability or data-loss risk exists.

8. Project timing, dependencies and appointments

Any project date or completion estimate depends on the confirmed scope and reasonable access to the people, accounts, devices, content and third-party services needed to do the work. Unless a completion date is expressly agreed, services are supplied within the timeframe required by applicable law.

Delays caused by missing credentials, domain-verification processes, provider outages, supplier response times, customer content or approvals, unavailable devices or newly discovered technical dependencies may reasonably extend an estimate. We will communicate material changes where practicable.

9. Change requests and additional work

If you request work outside the accepted scope, we may provide a separate fixed price, an updated project quote or an hourly support basis before proceeding. A change request can also affect the timeline.

Small corrections needed to deliver the agreed scope are not treated as a new project merely because they require rework. Separate charges apply only where permitted by law and where the work is genuinely additional or otherwise chargeable under the accepted agreement.

10. Handover, acceptance and support after the project

At handover, we may provide administrator details, ownership notes, configured devices, website access, migration status, known limitations and practical next steps relevant to the scope. You should review the handover and tell us promptly about an apparent issue so we can assess whether it is part of the agreed project.

Project completion does not create a managed-service or continuous-monitoring obligation. Ongoing monitoring, staff helpdesk, future website edits, Microsoft 365 administration, new users, later device changes, renewals and other post-project work are separate unless the accepted quote expressly includes them.

11. Deposits, cancellations and non-recoverable third-party costs

A deposit or advance payment may be required where disclosed before acceptance, including to reserve project time or purchase third-party items specifically for the project. If you cancel after authorised work has started, we may charge for work reasonably performed and any reasonable, disclosed third-party or special-order costs that cannot be recovered, subject to your rights under the Australian Consumer Law and other applicable law.

We do not use a cancellation term to remove a statutory right to a refund, re-supply, cancellation or other remedy where the law provides that right.

12. Privacy and confidential business information

We handle personal information as described in our Privacy policy. Project work may also expose us to business-confidential information that is not personal information, such as internal account structures, supplier details or operating documents. We use that information for the project and related service administration and expect customers to provide only information reasonably necessary for the agreed work.

Our delivery team may include team members and authorised contractors located in Australia and Vietnam. We limit access to what is reasonably needed for the assigned work and apply our relevant confidentiality, security and privacy controls. If a project requires us to use or configure an independent cloud or software provider, information may also be processed under that provider's terms and privacy practices. We will not knowingly add an unrelated third-party service to a project without a project reason.

13. Australian Consumer Law and fair standard-form terms

Services are provided subject to applicable consumer guarantees, including requirements concerning due care and skill, fitness for disclosed purpose and reasonable time where no time is agreed. Remedies may be available when a consumer guarantee is not met.

These terms are intended to operate consistently with laws protecting consumers and small businesses from unfair terms in standard-form contracts. We do not rely on a term to avoid an obligation that cannot lawfully be excluded or to impose an undisclosed unilateral change to an accepted project price or scope.

Website Care projects and ongoing maintenance

A website build sold with Solo Website Care or Small Business Website Care is a project for the initial build and an ongoing service for the monthly care component. The accepted quote records the build scope and price. Ongoing maintenance is additionally governed by the Website Care Terms. If the Website Care Terms deal more specifically with an ongoing website-care issue, they apply to that issue to the extent they are consistent with mandatory law and the accepted quote.

Website Care does not convert unrelated Business IT, Microsoft 365, hardware, software, cyber security, AI, automation or custom-development work into an unlimited subscription entitlement. Work outside the agreed website package remains separately scoped and approved.
